Forty Bellwether Trials Selected For Xarelto MDL 2592

Per Xarelto MDL 2592 Case Management Orders #2, #3 and #4 as well as the final order selecting the specific Plaintiff case for Bellwether Trials, 40 Bellwether Cases have been selected for the Xarelto MDL. Plaintiffs selected 10 of the cases and Defense selected 10 in a process somewhat similar to striking a jury. The remaining 20 cases were randomly selected with the assistance of Brown Greer. The Bellwether Cases are intended to be a representative sample of the “Universe” of cases comprising the entirety of all cases filed in the Xarelto MDL. Some of the factors included in the selection process with regard to individual cases being qualified to create a representative mix of cases included :

  1. Age
  2. Sex
  3. Severity of Injury
  4. Type of Injury

Complaint Synopsis:  Decedent was prescribed Xarelto in the State of Missouri, on or around March of 2013, upon direction of Decedent’s physician for the treatment of a DVT that developed above her knee. Complaint Synopsis: Plaintiff, Rodney Hannah, is the appointed administrator of the Estate of Tommie Lee Hannah by the Lamar County, Alabama Probate Court.  Decedent, Tommie Lee Hannah, was prescribed Xarelto on or about January 4, 2013, to reduce her risk of stroke and systemic embolism due to atrial fibrillation.  In deciding to take Xarelto, Decedent relied on various representations by the Defendants, including: that Xarelto was at least as safe and effective as other anticoagulant therapies; that patients were not required to undergo blood monitoring to establish or adjust their Xarelto dosage; and, that Xarelto included no dietary restrictions. Decedent, Tommie Lee Hannah was prescribed Xarelto in the State of
Alabama. . Thereafter, on or about May 18, 2013, Decedent, Tommie Lee Hannah presented to the Emergency Department of Fayette Medical Center
where she was diagnosed as having suffered from a cerebrovascular accident, to wit, a hemorrhagic stroke. Decedent, Tommie Lee Hannah, was transferred on May 19, 2013 to DCH Regional Medical Center for evaluation and treatment of the hemorrhagic stroke. Decedent remained hospitalized at DCH until June 3, 2013. At that time, doctors communicated her poor prognosis due to the severity of the intracranial hemorrhage to family. The family then decided to place Ms. Hannah in comfort care.
Decedent, Tommie Lee Hannah, passed away on June 5, 2013 at Hospice of West Alabama from the aforementioned injury.

Complaint Synopsis: Plaintiff, Frances McDaniel, ingested Xarelto from approximately March  9, 2015 until approximately August 30, 2015. She was transfused two  units of red blood cells on March 24, 2015, and she was diagnosed with  anemia, dypsnea and hematochezia. However, Frances McDaniel’s Xarelto therapy was reinstated thereafter. As a result, from May 12, 2015
through May 22, 2015, Plaintiff Frances McDaniel was hospitalized at  West Jefferson Medical Center and diagnosed with acute blood loss  anemia and transfused multiple units, all as a direct result of Xarelto. The Plaintiff, Frances McDaniel, resides in the Parish of Jefferson in the  State of Louisiana.

Complaint Synopsis: Plaintiff, Dora Mingo, was prescribed Xarelto on or about January 24, 2015, for the prophylaxis of deep vein thrombosis (“DVT”) following hip replacement surgery.  Plaintiff, Dora Mingo, was prescribed Xarelto in the State of Mississippi.  Thereafter, on February 13, 2015, Plaintiff, Dora Mingo, was admitted to Southwest Mississippi Regional Medical Center, in McComb, Mississippi, where she was diagnosed with acute upper gastrointestinal bleeding and acute blood loss anemia.  Plaintiff, Dora Mingo, received blood transfusions to treat her blood loss. Plaintiff remained hospitalized at Southwest Mississippi Regional Medical Center from February 13, 2015 through February 15, 2015. At the time of Plaintiff’s injury, she was taking Xarelto as prescribed.  As a result of her injuries, Plaintiff’s doctors ordered her to stop taking Xarelto.  Plaintiff’s injuries were directly and proximately caused by Xarelto.

complaints of dizziness, nausea, weakness, emesis and altered mental status. Sharyn Orr was  subsequently admitted to Ochsner Baptist with a hemorrhagic stroke. Sharyn Orr died 10 days
