Plaintiffs allege Monsanto's Roundup herbicide, a Glyphosate based product, can cause non-Hodgkin's lymphoma. Monsanto has attempted to bifurcate discovery to address general causation issues before plaintiff specific issues with varying success. There are conflicting opinions and data regarding Roundup's dangers, and Monsanto relies on FDA and other oversight agency rulings that permit widespread use across the USA and around the world in residential, agricultural and commercial applications. Plaintiffs often cite scientific studies and data from outside the USA that are directly in opposition to Monsanto's view of Roundup as a safe product. The European Union is currently considering a total ban on Roundup and all other Glyphosate based products for residential and agricultural use. The case is assigned to the US District Court of California Northern District, Judge Chhabria, who was appointed in 2014 by President Obama and has no MDL experience to date. Monsanto is expected to aggressively litigate all issues in this MDL, and there will be an extensive motion and briefing exchange throughout.
